⚠️ ESSENTIAL LEGAL NOTICE — TestVocacional.app is a platform with exclusively guidance, educational, and informational purposes. Its results do not constitute a psychological, clinical, or certified professional diagnosis of any kind. For any important academic or professional decision, always consult a licensed professional in your country.

These Terms and Conditions of Service ("Terms" or "TCS") govern access to and use of the TestVocacional.app web and mobile platform (the "Platform"), operated by Federico Osella, with registered address at José A. Nanini 3154, Colonia Caroya, Córdoba, Republic of Argentina (the "Owner", "we", "us").

By accessing, registering, installing the app, or using the Platform in any way, you ("User") declare that you have read, understood, and fully accepted these Terms, the Privacy Policy, and the Cookies Policy. If you do not accept any of these documents in their entirety, you must refrain from using the Platform.

1Owner Identification


2Nature of the service and essential limitations

2.1 What is TestVocacional.app

TestVocacional.app is a digital vocational guidance platform with exclusively guidance, educational, and informational purposes. It combines internationally recognized psychometric instruments, proprietary analysis algorithms, and curated content, with the aim of helping Users explore their interests, aptitudes, and possible academic or professional paths.

The informational and vocational guidance content available on the Platform — including videos, articles, and support materials — has been prepared or reviewed by vocational area professionals. Such professional participation refers exclusively to the preparation and review of general content, and does not in any case imply individual care, diagnosis, or assessment of any User.

2.2 Scope and limitations

The tests, questionnaires, results, reports, career recommendations, and any other content generated by the Platform:

  • DO NOT constitute a psychological, psycho-pedagogical, or clinical diagnosis of any kind, nor the practice of any regulated profession.
  • DO NOT replace personalized guidance from a licensed professional (psychologist, psycho-pedagogue, vocational counselor) who knows the User's particular situation.
  • ARE NOT binding and must not be interpreted as a definitive recommendation on which career, study program, or employment to pursue.
  • DO NOT guarantee academic, professional, or personal outcomes of any kind.
  • Present the margins of error inherent to any psychometric tool applied in digital format and in an unsupervised manner.
📋 Essential notice — read before interpreting any result
The results generated by TestVocacional.app are for guidance and informational purposes only. They do not represent a psychological diagnosis or an individual clinical evaluation. The professionals whose content appears on the Platform participated in the preparation or review of general informational material, and have no connection with the individual results of each User or with the decisions they make. For any important academic or professional decision, always consult a licensed professional in your country.

2.3 Theoretical models and instruments

The questionnaires are based on theoretical frameworks in the public domain or openly licensed, including:

The Owner acknowledges the original authorship of the instruments cited. The technological adaptation, Platform implementation, and results presentation methodology are the Owner's own work.


3Eligibility and minors

3.1 Minimum ages

Note for parents and guardians: The Platform is especially aimed at high school students. If a minor under 16 wishes to use it, the responsible adult must contact us at the email indicated in Section 20 to manage verifiable parental consent, in accordance with GDPR (Art. 8), COPPA, and equivalent regulations in other jurisdictions.

3.2 Parental responsibility

The parent or legal guardian who authorizes a minor's use assumes full responsibility for: (a) supervising the minor's use of the Platform; (b) appropriately interpreting results together with the minor; (c) any consequences arising from the minor's use of the Platform.

3.3 Age declaration at registration

By checking the age confirmation checkbox at registration ("I confirm I am 16 years of age or older"), the User makes a self-declaration under their sole responsibility. If the declaration is false, the Owner is exonerated from all liability arising from the minor's use of the Platform.


4Registration and user account

4.1 Account creation

To access full features, the User must create an account by providing the data in the registration form (detailed in Section 5). Registration may also be completed via third-party login (Google, Facebook, or others). By doing so, the User authorizes obtaining the basic data those platforms share according to their privacy settings.

4.2 User obligations regarding their account

  • Provide truthful, current, and complete information.
  • Keep their access credentials confidential.
  • Notify the Owner immediately upon any unauthorized use of their account.
  • Not share access to their account with third parties.
  • Register only one account per individual.

4.3 Account responsibility

The User is solely responsible for all activities carried out from their account. The Owner will not be liable for damages arising from unauthorized access to User accounts, unless such access is a direct result of a security breach attributable to the Owner.


5Data we collect upon registration

During the registration process (the "LegalGate" screen in the app), we collect the following data:

Important about payments: TestVocacional.app does NOT collect or store credit card, debit card, or any other payment instrument data. All payments are processed entirely by Apple (App Store) or Google (Google Play), under their own privacy and security policies.

6Free plan and Premium subscriptions

6.1 Free plan

TestVocacional.app offers free access allowing any User to: take selected vocational tests, view a basic summary of results, and access general informational content on the Platform. The free plan may include advertising. The Owner reserves the right to modify the content included in the free plan at any time and without prior notice.

6.2 Premium subscription

The Premium subscription unlocks full access to the Platform, including (without limitation):

  • Extended results with detailed analysis, recommended careers and trades.
  • Access to all available tests.
  • Unlimited chat with Vockly (vocational AI) and with professionals.
  • Premium activities, PDFs, videos, and audio content.
  • Intelligent search across more than 1,800 careers and trades.
  • Combined results with proprietary algorithm.
  • Ad-free experience.

6.3 Available subscription plans

Available plans, their price, and duration are shown to the User on the in-app subscription screen (paywall), with the applicable price according to their region and store (App Store or Google Play). Prices may vary by country, exchange rate, and the respective store's policies. The Owner reserves the right to modify available plans and their prices, providing reasonable advance notice.

6.4 Automatic renewal

Subscriptions automatically renew at the end of each period (weekly or monthly) unless the User cancels at least 24 hours before the end of the current period, in accordance with Apple App Store or Google Play policies. The renewal is charged to the payment method registered in the respective store.


7Payments and billing through Apple and Google

7.1 Exclusive processing by the stores

All Premium subscription payments are processed exclusively through:

  • Apple App Store (for iOS/iPadOS devices): subject to Apple's Terms of Service and Privacy Policy.
  • Google Play (for Android devices): subject to Google Play's Policies and Google's Privacy Policy.

The Owner does not have access to, store, or process Users' payment data (card number, bank details, etc.). Any queries about charges, receipts, or billing data must be directed to the corresponding store.

7.2 Charge at the time of subscription

Upon confirming a Premium subscription, the corresponding amount is immediately charged to the payment method linked to the User's App Store or Google Play account. By subscribing, the User expressly authorizes recurring charges until cancellation.

7.3 Restore purchases (iOS)

iOS Users can restore previous purchases using the "Restore purchases" button available on the subscription screen. This function does not constitute a new purchase.

📌 Temporary purchase disabling
Under certain technical or regulatory circumstances, the Owner may temporarily disable the new subscription option. In such case, a notice will be displayed in the app. Users with active subscriptions will not be affected.

8Refunds and cancellations

8.1 Refund policy

Since payments are processed by Apple or Google, refunds are governed by each store's refund policies, not by the Owner directly. The Owner cannot manage refunds for purchases made through the stores.

  • Apple (iOS): To request a refund, visit reportaproblem.apple.com within Apple's established timeframe.
  • Google (Android): To request a refund, contact Google Play support within Google's established timeframe.

8.2 Subscription cancellation

The User may cancel their subscription at any time:

  • iOS: Device Settings → Apple ID → Subscriptions → TestVocacional → Cancel subscription.
  • Android: Google Play → Library → Subscriptions → TestVocacional → Cancel subscription.

Cancellation takes effect at the end of the current period. No proportional refunds are issued for the already-paid period, unless the corresponding store's policy expressly provides for this.

8.3 Trial period

When the Owner offers a free trial period, the User must cancel before that period ends to avoid automatic billing. The availability, duration, and conditions of the trial period will be communicated on the subscription screen and are subject to Apple or Google policies.


9Intellectual property

9.1 Owner's ownership

All elements of the Platform are the exclusive property of Federico Osella or their respective licensors, including without limitation:

  • Graphic design, user interface (UI), and user experience (UX).
  • Source code, algorithms, databases, app structure.
  • Brand, logo, trade names "TestVocacional.app" and "Test Vocacional".
  • Original texts, content adaptations, and results presentation methodology.
  • Translations and versions in other languages of proprietary content.
  • Character and name "Vockly" and any AI or proprietary assistant of the Platform.

Nothing in these Terms grants the User any right, title, or interest in the Owner's intellectual property.

9.2 User content

The User retains ownership rights over content they voluntarily contribute to the Platform (reviews, public comments). By submitting it, they grant the Owner a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, adapt, and publish such content for the sole purpose of providing and improving the services.

9.3 Prohibition of reverse engineering

It is expressly prohibited to decompile, disassemble, reverse engineer, copy, or attempt to obtain the source code of the Platform or any of its components, in whole or in part.


10License to use

The Owner grants the User a personal, limited, non-exclusive, non-transferable, revocable license to access and use the Platform exclusively for their personal, non-commercial purposes, in accordance with these Terms. This license does not include:

  • Sublicensing, selling, reselling, or commercializing access to the Platform.
  • Modifying, adapting, or creating derivative works.
  • Using the Platform for commercial or scientific research purposes without prior written authorization.
  • Scraping, data mining, or mass extraction of information.
  • Accessing via bots, automated scripts, or similar tools.

11Prohibited uses

The following are expressly prohibited for Users:

  1. Using the Platform for any unlawful, fraudulent, or public-order-contrary purpose.
  2. Impersonating another person, entity, or organization.
  3. Transmitting viruses, malware, ransomware, or any malicious code.
  4. Attempting unauthorized access to Platform systems, servers, or databases.
  5. Interfering with the normal operation of the Platform or its servers.
  6. Using the Platform commercially without the Owner's written authorization.
  7. Collecting personal data of other Users without consent.
  8. Publishing defamatory, discriminatory, obscene content, or content that infringes third-party rights.
  9. Performing scraping or mass data extraction.
  10. Creating multiple accounts to circumvent blocks or restrictions.
  11. Using test results for personnel selection decisions, discrimination, or any other use that affects the fundamental rights of third parties.
  12. Reproducing or distributing Platform content without authorization.
  13. Falsely declaring one's own age or a third party's age to access the Platform.
Violations may result in immediate account suspension or termination and the exercise of corresponding legal actions.

12Limitation of liability

12.1 Exoneration for use of results

THE OWNER SHALL NOT BE LIABLE FOR ANY ACADEMIC, PROFESSIONAL, OR PERSONAL DECISION THE USER MAKES BASED ON TEST RESULTS. THE USE OF SUCH RESULTS IS THE USER'S SOLE RESPONSIBILITY.

12.2 General exoneration

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE OWNER SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION: damages arising from decisions made based on test results; economic, academic, or professional losses; emotional or psychological damages arising from the use or interpretation of results; Platform interruptions or malfunctions; data loss for causes not attributable to the Owner; damages caused by viruses or other harmful technological elements of third parties; inaccuracy, error, or obsolescence of content; issues related to payment processing by Apple or Google.

12.3 Maximum liability cap

In no event shall the Owner's total liability to the User, for any cause and under any legal theory, exceed USD 100 (one hundred US dollars), or the equivalent of the amount paid by the User in the last thirty (30) days, whichever is greater. This limitation applies even if the Owner has been informed of the possibility of such damages.

12.4 Disclaimer of warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. THE OWNER DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT THE RESULTS WILL BE ACCURATE FOR ANY PARTICULAR PURPOSE.

12.5 Express assumption of risk

The User acknowledges and expressly accepts that use of the Platform and interpretation of its results entail inherent risks which they consciously and voluntarily assume, exonerating the Owner from all liability arising from such decisions.


13User indemnification

The User agrees to defend, indemnify, and hold harmless the Owner, their collaborators, employees, contractors, and assignees from and against any claim, liability, damage, loss, cost, or fee (including reasonable attorney's fees) arising out of or related to:

  • Use of the Platform by the User or third parties accessing through their account.
  • The User's violation of any provision of these Terms.
  • Infringement of third-party rights, including intellectual property or privacy rights.
  • Any content the User contributes to the Platform.
  • Decisions the User makes based on test results.
  • False age or identity declarations by the User.

14Privacy and personal data protection

The processing of Users' personal data is governed by the Privacy Policy, which forms an integral part of these Terms.

14.1 Applicable regulatory framework

Note for US users (CCPA): California residents have the right to know what personal information is collected, to request deletion, to opt out of the sale of personal information, and to non-discrimination for exercising these rights. To exercise any CCPA right, contact us at the address in Section 20.

14.2 Test response data — processing and confidentiality

Test response data may reveal aspects of the User's personality, preferences, and interests. The Owner expressly states that it:

  • Does not sell or commercialize test responses or results to any third party.
  • Does not share such data with third parties without the User's explicit consent, except where legally required.
  • Does not use them for commercial profiling unrelated to the service operation, nor for automated decisions with legal or significant effects on the User.
  • Uses data exclusively to generate the User's own results and reports and to improve Platform quality in an aggregated, anonymized manner.

14.3 Recorded consents

By accepting these Terms and the Privacy Policy at registration, the system automatically records a timestamp (date and time in seconds) of consent, associated with the User's account. This record constitutes evidence of informed consent.

14.4 Push notifications

The option to receive push notifications is disabled by default (opt-out). The User may enable or disable it at any time from the app or device settings. Enabling it implies consent to receive Platform-related communications.


15Modifications to these Terms

The Owner reserves the right to modify these Terms at any time. When modifications are significant, the User will be notified via: (a) a prominent notice on the Platform; (b) email to the registered address; (c) updating the "Last updated" date in this document.

Continued use of the Platform after the modifications take effect implies acceptance. If the User does not accept the new conditions, they must cease using the Platform and request account cancellation.


16Account suspension and termination

16.1 Termination by the User

The User may cancel their account at any time by contacting the Owner at [email protected]. Account cancellation does not automatically cancel active subscriptions on Apple or Google — these must be cancelled directly in the corresponding store (see Section 8.2).

16.2 Suspension or termination by the Owner

The Owner reserves the right to suspend or cancel accounts, with or without prior notice, in cases of: (a) breach of these Terms; (b) fraudulent or abusive use; (c) detection of age below the minimum; (d) request from a competent authority; (e) prolonged inactivity (more than 12 months); (f) technical, legal, or security necessity.

Account cancellation does not entitle the User to a refund for unused subscription time, unless the corresponding store establishes otherwise.


17Third-party services and sites

The Platform may contain links, integrations, or references to third-party services (app stores, social networks, analytics services, etc.). The Owner does not control and is not responsible for the content, policies, or practices of such third parties. Access to third-party services is at the User's sole responsibility, and the User must review their own terms and policies.


18Dispute resolution and jurisdiction

18.1 Mandatory amicable resolution

For any dispute arising from these Terms, the User agrees to first attempt amicable resolution by contacting the Owner as per Section 20. The Owner will respond within a maximum of 30 business days.

18.2 Applicable law and jurisdiction — Argentina and LATAM

For Users residing in Argentina and Latin America, these Terms are governed and interpreted in accordance with the laws of the Republic of Argentina. Any dispute not resolved amicably will be submitted to the exclusive jurisdiction of the Ordinary Courts of the city of Córdoba, Republic of Argentina.

18.3 European Union Users

Users residing in the EU/EEA retain the unwaivable right to resort to the courts of their country of residence and to the competent data protection authorities. Nothing in these Terms limits the rights that European consumer protection and data subject regulations recognize as mandatory.

EU and Spanish users may file privacy complaints with the Spanish Data Protection Agency (AEPD) at www.aepd.es, or with the supervisory authority in their country of residence.

18.4 United States Users

US Users, including California residents, retain all rights granted by applicable federal and state privacy laws, including CCPA/CPRA and COPPA. Nothing in these Terms waives those rights. Disputes involving US consumers may be subject to applicable federal and state consumer protection laws.

18.5 Non-waivable consumer rights

Nothing in these Terms excludes or limits the rights that the User may have under consumer protection legislation applicable in their country of residence, which cannot be contractually waived.


19General provisions

19.1 Entire agreement

These Terms, together with the Privacy Policy and any additional policies published on the Platform, constitute the entire agreement between the User and the Owner with respect to use of the Platform.

19.2 Severability

If any provision is declared null or unenforceable, it will be modified to the minimum extent necessary to make it valid, or eliminated, without affecting the validity of the remainder.

19.3 Waiver

The Owner's failure to exercise any right provided in these Terms does not constitute a waiver of that right.

19.4 Assignment

The User may not assign their rights or obligations without the Owner's written consent. The Owner may assign these Terms, including in connection with a merger, acquisition, or asset sale, providing the User with reasonable advance notice.

19.5 Force majeure

The Owner shall not be liable for failures caused by circumstances beyond their reasonable control: natural disasters, pandemics, government acts, Internet infrastructure failures, cyberattacks, or third-party service outages.

19.6 Prevailing language

The official version of these Terms is the one drafted in Spanish. In the event of translation into other languages, the Spanish version shall prevail in case of any contradiction. This English translation is provided for convenience only.

19.7 Technological updates

The Owner reserves the right to modify, suspend, or discontinue any feature or the entire Platform at any time and without prior notice, without incurring liability, except with respect to already-paid active subscriptions.
